These Terms ("Terms") govern your access to and use of Quell (the "Service"), including our website and web application (collectively, "Quell," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms.

2. Eligibility You must be at least 18 years old (or the age of majority where you live) to use the Service.
3. Accounts You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
4. License and acceptable use We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal, non-commercial use. You agree not to:
- copy, modify, reverse engineer, or attempt to extract the source code of the Service
- misuse the Service, interfere with its operation, or access it in an unauthorized manner
- use the Service to violate any law or infringe anyone's rights
5. Purchases, pricing, and payment processing Quell is offered as a one-time annual payment (currently described as $365 for one year; no subscription). Payments are processed by our payment processor (e.g., Stripe). We do not store your full payment card number.
6. Delivery and access After successful payment, you receive access to the Service. Access is delivered digitally via our web application and is tied to your account credentials.
7. 10-day guarantee / refunds We offer a 10-day guarantee: If you're not calmer, clearer, and steadier when it counts, email hello@thequellapp.com within 10 days of purchase and request a refund. Full refund. No questions asked. Refunds are issued to the original payment method when possible.
8. Health and medical disclaimer Quell provides education and guided practices for general wellness and self-regulation. It is not medical care and does not provide medical advice, diagnosis, or treatment. Do not use the Service as a substitute for professional medical or mental health advice.
9. Intellectual property All content, trademarks, and other intellectual property in the Service are owned by Quell or our licensors. You may not use our trademarks without our prior written permission.
10. Third-party services The Service may integrate with third-party services (for example, payment processing, authentication). Your use of third-party services may be subject to their terms and policies.
11. Disclaimers The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Limitation of liability To the fullest extent permitted by law, Quell will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly.
13. Indemnification You agree to indemnify and hold harmless Quell and its affiliates, officers, employees, and agents from any claims, liabilities, damages, and expenses arising out of your use of the Service or violation of these Terms.
14. Termination We may suspend or terminate your access to the Service if you violate these Terms. You may stop using the Service at any time.
15. Governing law These Terms are governed by the laws of British Columbia, Canada.
16. Changes to these Terms We may update these Terms from time to time. If we make material changes, we will update the effective date and post the updated Terms.
